It supplements the <a href=\"https:\/\/promastro.be\/en\/privacy-policy\/\">privacy policy<\/a>, to which it refers for definitions and the general framework.<\/p>\n\n<h2>1. Your right to erasure<\/h2>\n\n<h3>1.1 Legal basis<\/h3>\n<p>Article 17 of the GDPR grants you the right to obtain from the data controller (<strong>ProMastro<\/strong> \u2014 Mr Dennys Pillitteri, sole proprietorship, CBE 0877.004.615) the erasure of personal data concerning you without undue delay, where one of the following grounds applies:<\/p>\n<p><strong>a)<\/strong> The data are no longer necessary in relation to the purposes for which they were collected;<br>\n<strong>b)<\/strong> You withdraw the consent on which the processing was based and there is no other legal basis;<br>\n<strong>c)<\/strong> You object to the processing and there are no overriding legitimate grounds;<br>\n<strong>d)<\/strong> The data have been unlawfully processed;<br>\n<strong>e)<\/strong> The data must be erased to comply with a legal obligation;<br>\n<strong>f)<\/strong> The data were collected in relation to the offer of services to a minor (Art. 8 GDPR).<\/p>\n\n<h3>1.2 Response time<\/h3>\n<p>ProMastro undertakes to process your request within a maximum of <strong>one (1) month<\/strong> from its receipt (Art. 12.3 GDPR), extendable by two further months for complex requests after reasoned notification.<\/p>\n\n<h3>1.3 Limits to the right to erasure<\/h3>\n<p>In accordance with Article 17.3 of the GDPR, the right to erasure <em>does not apply<\/em> to the extent that processing is necessary:<\/p>\n<p><strong>a)<\/strong> For exercising the right to freedom of expression and information (the case of published reviews \u2014 see \u00a74 below);<br>\n<strong>b)<\/strong> For compliance with a legal obligation (the case of invoices and accounting data \u2014 see \u00a75);<br>\n<strong>c)<\/strong> For reasons of public interest;<br>\n<strong>d)<\/strong> For the establishment, exercise or defence of legal claims.<\/p>\n\n<h2>2. How do I delete my account?<\/h2>\n\n<h3>2.1 Option A \u2014 From your dashboard (recommended)<\/h3>\n<p>The online procedure is the fastest and allows immediate deletion of the account. Four steps:<\/p>\n<p><strong>Step 1<\/strong>: log in to <a href=\"https:\/\/promastro.be\/en\/dashboard\/\">your dashboard<\/a> with your email and password;<br>\n<strong>Step 2<\/strong>: go to the &#8220;<strong>My profile<\/strong>&#8221; tab (visitor) or &#8220;<strong>My subscription<\/strong>&#8221; tab (professional);<br>\n<strong>Step 3<\/strong>: click the &#8220;<strong>Delete my account<\/strong>&#8221; button at the bottom of the page (&#8220;Danger zone&#8221; area);<br>\n<strong>Step 4<\/strong>: confirm your choice in the confirmation window, entering your password for confirmation if requested.<\/p>\n<p>The account is deactivated immediately. You will receive a confirmation email at the registered address. No fee is charged for deletion.<\/p>\n\n<h3>2.2 Option B \u2014 By email<\/h3>\n<p>If you can no longer access your dashboard (forgotten password, changed email, etc.), send your request by email:<\/p>\n<p><strong>Dedicated GDPR address<\/strong>: <a href=\"mailto:rgpd@promastro.be\">rgpd@promastro.be<\/a><br>\n<strong>General address (in copy)<\/strong>: <a href=\"mailto:contact@promastro.be\">contact@promastro.be<\/a><br>\n<strong>Recommended subject line<\/strong>: &#8220;Account deletion \u2014 [Last name First name or Company name]&#8221;<\/p>\n<p>The request must be sent from the <strong>email address associated with the account<\/strong>. If this is not possible, reasonable identity verification may be requested (sending a redacted copy of an identity document \u2014 you may mask all data not required for verification, in accordance with the data minimisation principle, Art. 5.1.c GDPR).<\/p>\n\n<h3>2.3 Option C \u2014 By phone<\/h3>\n<p>You may initiate the procedure by phone at <a href=\"tel:+32465864778\">+32 (0)465 86 47 78<\/a>, Monday to Friday from 9 a.m. to 6 p.m. (Belgian time). For traceability and identity verification purposes, a <strong>written confirmation by email<\/strong> will additionally be requested.<\/p>\n\n<h3>2.4 Option D \u2014 By post<\/h3>\n<p>You may send a written request to:<\/p>\n<p>ProMastro \u2014 Mr Dennys Pillitteri<br>\nChauss\u00e9e d&#8217;Alsemberg 854<br>\n1420 Braine-l&#8217;Alleud<br>\nBelgium<\/p>\n<p>The request must be dated, signed, and accompanied by a copy of an identity document (always in compliance with the minimisation principle: only the last name, first name, photo and date of birth are necessary).<\/p>\n\n<h2>3. What happens after the request?<\/h2>\n<p>The processing of your request follows a precise, tracked timeline:<\/p>\n<table>\n<thead><tr><th>Timeframe<\/th><th>Action taken<\/th><\/tr><\/thead>\n<tbody>\n<tr><td><strong>Immediately<\/strong><\/td><td>Account deactivated. No further login possible. Professional listing (where applicable) unpublished from the Site, removed from internal search results, marked <code>noindex<\/code> for external search engines.<\/td><\/tr>\n<tr><td><strong>Within 24 hours<\/strong><\/td><td>Automatic notification to external search engines (Google Indexing API, IndexNow for Bing\/Yandex) to speed up de-indexing.<\/td><\/tr>\n<tr><td><strong>Within 7 days<\/strong><\/td><td>Written confirmation by email that your request has effectively been taken into account, with a summary of the next steps.<\/td><\/tr>\n<tr><td><strong>Within 30 days<\/strong><\/td><td>Effective anonymisation of reviews and messages (see \u00a74); verification that de-indexing by search engines is effective.<\/td><\/tr>\n<tr><td><strong>Within 90 days<\/strong><\/td><td>Permanent deletion of user data via an automatic daily cron. The URLs of former listings return an HTTP <code>410 Gone<\/code> status.<\/td><\/tr>\n<tr><td><strong>Indefinitely<\/strong><\/td><td>Data retained under a legal obligation (see \u00a75): isolated in a separate system not publicly accessible, retention period depending on the type of data.<\/td><\/tr>\n<\/tbody>\n<\/table>\n\n<h3>3.1 Why 90 days of technical archiving?<\/h3>\n<p>The 90-day technical archiving period meets three legitimate needs:<\/p>\n<p><strong>Recovery in case of error or hacking<\/strong>: if the deletion request resulted from a mistake, or if your account was hacked and used to request deletion without your knowledge, you have 90 days to react and obtain restoration.<br>\n<strong>Natural closure of ongoing conversations<\/strong>: if you were in an active discussion with a Pro (quote, messages), the conversation can come to a natural close on their side.<br>\n<strong>Archiving of ongoing disputes<\/strong>: if a complaint, report or procedure involving your data was ongoing, it must be able to conclude under fair conditions.<\/p>\n\n<h2>4. What happens to my content?<\/h2>\n\n<h3>4.1 Content permanently deleted after 90 days<\/h3>\n<p><strong>Photos, gallery, before\/after projects, editorial description<\/strong>: permanent deletion of the physical files from the server, removal of database references, anonymisation of audit entries.<br>\n<strong>Contact details<\/strong>: last name, first name, address, phone, email, CBE\/VAT data, KYC data (where applicable).<br>\n<strong>Favourites<\/strong>: immediate deletion as soon as the request is made.<br>\n<strong>Social profile<\/strong>: all references to any Facebook\/Instagram\/LinkedIn profiles provided.<\/p>\n\n<h3>4.2 Anonymised content (Art. 17.3.a GDPR)<\/h3>\n<p><strong>Reviews you have posted<\/strong>: the author&#8217;s name is replaced by &#8220;<em>Deleted user<\/em>&#8220;, but <strong>the text of the review remains visible<\/strong>. This arrangement results from the direct application of Article 17.3.a of the GDPR, which excludes the right to erasure where processing is necessary for exercising the <em>right to freedom of expression and information<\/em>. Reviews published on ProMastro fall under the public&#8217;s right to fair information (Art. VI.45\/1 of the Belgian Code of Economic Law on the transparency of reviews). Their outright deletion would undermine the information available to other users.<\/p>\n<p><em>Special case of identifying data in the body of a review<\/em>: if the text of a review you posted contains identifying personal data (a third party&#8217;s full name, precise address, phone number, licence plate, etc.), you may request its targeted redaction at <a href=\"mailto:rgpd@promastro.be\">rgpd@promastro.be<\/a>. This request will be processed separately from the account deletion.<\/p>\n<p><strong>Messages sent or received<\/strong>: retained in anonymised form to preserve the other party&#8217;s history (who is entitled to keep their own history). Permanently deleted after 90 days.<br>\n<strong>Reports submitted<\/strong>: retained anonymised and useful for the traceability of moderation in accordance with the DSA Regulation (EU) 2022\/2065.<\/p>\n\n<h2>5. Data retained under a legal obligation<\/h2>\n<p>Certain data cannot be deleted immediately, pursuant to mandatory legal provisions. They are then archived in a <strong>separate system not publicly accessible<\/strong>, access to them is restricted to what is strictly necessary (data controller, accountant, in the event of an administrative audit), and their retention is limited to the legal period.<\/p>\n<table>\n<thead><tr><th>Data<\/th><th>Period<\/th><th>Legal basis<\/th><\/tr><\/thead>\n<tbody>\n<tr><td>Invoices issued and accounting data<\/td><td><strong>7 years<\/strong><\/td><td>Art. 60 Belgian VAT Code; Art. III.86 Code of Companies and Associations<\/td><\/tr>\n<tr><td>KYC supporting documents (if identity verification enabled)<\/td><td>5 years after the end of the relationship<\/td><td>Anti-money laundering Act of 18 September 2017, Art. 60<\/td><\/tr>\n<tr><td>Security logs (bruteforce attempts, detected fraud)<\/td><td>1 year<\/td><td>Fraud prevention \u2014 legitimate interest, Art. 6.1.f GDPR<\/td><\/tr>\n<tr><td>Contract data (accepted terms of use\/terms of sale, version, date)<\/td><td>5 years<\/td><td>Art. 2262bis Civil Code \u2014 contractual limitation period<\/td><\/tr>\n<tr><td>Specific tax data (intra-EU VAT)<\/td><td>10 years<\/td><td>VAT One Stop Shop (OSS) scheme \u2014 Directive (EU) 2017\/2455<\/td><\/tr>\n<\/tbody>\n<\/table>\n<p><em>These legal retentions do not constitute a circumvention of the right to erasure: they stem from obligations that apply to ProMastro in the same way they would apply to any business.<\/em><\/p>\n\n<h2>6. The case of a professional account with an active subscription<\/h2>\n\n<h3>6.1 Interplay between deletion and cancellation<\/h3>\n<p>If you have an ongoing Pro subscription at the time of the deletion request, two distinct operations coexist:<\/p>\n<p><strong>1. Account deletion<\/strong> (Art. 17 GDPR): erasure of personal data according to the timeframes and arrangements described in \u00a73-5;<br>\n<strong>2. Subscription cancellation<\/strong> (Terms of Sale Art. 9): end of the service contract. The deletion request automatically triggers the cancellation of the subscription at the end of the paid period.<\/p>\n<p>Combined consequences:<\/p>\n<p><strong>The listing is unpublished immediately<\/strong> from the Site (subject of the erasure, Art. 17 GDPR);<br>\n<strong>The subscription remains &#8220;active&#8221; until its expiry date for accounting compliance<\/strong> (obligation to invoice the period due) \u2014 no partial refund is owed (see <a href=\"https:\/\/promastro.be\/en\/terms-of-sale\/\">Terms of Sale<\/a>, Art. 9);<br>\n<strong>No new invoice<\/strong> will be issued after the final due date.<\/p>\n\n<h3>6.2 Alternative: cancel without deleting<\/h3>\n<p>If you wish to cancel your Pro subscription without permanently deleting your account (for example to keep your favourites and reviews as a visitor), use the &#8220;<strong>Cancel my subscription<\/strong>&#8221; button in the &#8220;My subscription&#8221; tab of your dashboard. The account then retains the <code>apb_visiteur<\/code> role with the associated personal data, without the pro data.<\/p>\n\n<h2>7. Recovering a deleted account<\/h2>\n<p>During the <strong>90-day<\/strong> technical archiving period, you may request the reactivation of your account by writing to <a href=\"mailto:rgpd@promastro.be\">rgpd@promastro.be<\/a> from the associated email address. Reasonable identity verification may be requested.<\/p>\n<p>Beyond 90 days, deletion is <strong>permanent and irreversible<\/strong>. No restoration is technically possible (backups are also purged). It is then up to you to create a new account if you wish to use the Site again. <em>Please note<\/em>: if you were a Pro and a free trial has already been used on the VAT number in question, a new trial cannot be granted to you (see <a href=\"https:\/\/promastro.be\/en\/free-trial-policy\/\">free trial policy<\/a>, \u00a74).<\/p>\n\n<h2>8. Right to lodge a complaint<\/h2>\n<p>If your deletion request is not processed within the deadlines (one month, extendable by two months in case of complexity, Art. 12.3 GDPR), or if you believe your rights have been disregarded, you may lodge a complaint with the Belgian <strong>Data Protection Authority (APD\/GBA)<\/strong>, the independent supervisory authority:<\/p>\n<p><strong>Address<\/strong>: Rue de la Presse 35, 1000 Brussels<br>\n<strong>Phone<\/strong>: +32 (0)2 274 48 00<br>\n<strong>Email<\/strong>: <a href=\"mailto:contact@apd-gba.be\">contact@apd-gba.be<\/a><br>\n<strong>Website<\/strong>: <a href=\"https:\/\/www.autoriteprotectiondonnees.be\" rel=\"noopener\" target=\"_blank\">autoriteprotectiondonnees.be<\/a><\/p>\n<p>You also have the right to an <strong>effective judicial remedy<\/strong> (Art. 79 GDPR), without prejudice to any other administrative or non-judicial remedy.<\/p>\n\n<h2>9. Deletion initiated by ProMastro (special cases)<\/h2>\n\n<h3>9.1 D90 cron \u2014 accounts ended for 90 days<\/h3>\n<p>In accordance with the <a href=\"https:\/\/promastro.be\/en\/privacy-policy\/\">privacy policy<\/a> (\u00a75), an automatic daily cron permanently deletes the data of accounts that have had the <code>ended<\/code> status for more than 90 days. This automated processing is documented, traceable, and complies with the storage limitation principle (Art. 5.1.e GDPR).<\/p>\n\n<h3>9.2 Deletion for serious breach<\/h3>\n<p>ProMastro may decide, by a reasoned and tracked decision, to delete an account in the event of a proven serious breach of the Terms of Use (established fraud, publication of unlawful content, identity theft). Such a decision is notified to the user in advance, unless the security of the Site or of other users requires urgent action. The user then has an internal remedy (reply to <a href=\"mailto:contact@promastro.be\">contact@promastro.be<\/a>) before any external action.<\/p>\n\n<h2>10.
