Terms of Use

1. Purpose
These Terms of Use (“ToU”) govern access to and use of the ProMastro website, available at promastro.be (hereinafter the “Site”), published by Mr Dennys Pillitteri, a sole proprietorship under Belgian law registered with the CBE (Crossroads Bank for Enterprises) under no. 0877.004.615 (VAT BE 0877.004.615), trading under the commercial name ProMastro, with registered office at Chaussée d’Alsemberg 854, 1420 Braine-l’Alleud (Belgium), hereinafter “ProMastro” or “the publisher”. The publisher’s full contact details can be found on the legal notice page.
“ProMastro” is the sole commercial name under which the publisher operates its directory of Belgian professionals, which is the subject of these ToU. The service is available at promastro.be.
Any use of the Site implies full and unconditional acceptance of these ToU.
2. Definitions
- Visitor: any internet user browsing the Site without registering.
- User: a visitor holding a free account (role
apb_visiteur). - Professional or “Pro”: a user holding a paid account (role
apb_pro) and a published professional listing. - Content: any text, image, review, photo or information published on the Site.
3. Access to the Site
Access to the Site is free of charge for Visitors and Users. Access to the Pro service is subject to taking out a paid subscription (see Terms of Sale).
ProMastro endeavours to ensure maximum availability of the Site but cannot be held liable for interruptions due to maintenance, the hosting provider or external causes.
4. User accounts
Registration requires a valid email address and a password meeting the security requirements displayed. Pro registration additionally requires a valid Belgian VAT number (verified via VIES) and the purchase of a subscription.
Each user is responsible for keeping their login credentials confidential. The user undertakes to inform ProMastro without delay in the event of fraudulent use of their account.
5. Services offered
- For Visitors: searching for professionals, direct contact, posting reviews after registration, managing favourites.
- For Pros: publishing a listing, managing a gallery/projects, receiving messages, statistics, quality badges, PEPPOL invoicing.
ProMastro charges no commission on transactions between Visitors and Pros. The service is purely a directory connecting the two parties.
6. User obligations
The user undertakes to:
- Provide accurate and up-to-date information;
- Refrain from publishing content that is defamatory, abusive, fraudulent or contrary to Belgian and European law;
- Respect intellectual property rights (photos, texts);
- Refrain from using the Site for automated prospecting, scraping or identity theft;
- For Pros: hold the legal authorisations required to carry out their activity (active CBE number, ten-year liability insurance where applicable, declared certifications).
7. Moderation of reviews and content
Published reviews and content are subject to combined moderation:
- Automated a priori moderation by artificial intelligence (Anthropic’s Claude model) — detection of spam, insults, manifestly illegal or off-topic content;
- Human review in case of doubt or upon a report (reactive moderation);
- Right of reply for the Pro concerned by a review;
- Appeal in the event of rejection or removal: a human moderator may be called upon for re-examination, in accordance with Article 22 of the GDPR and Article 20 of the DSA Regulation.
The full rules and the reporting procedure are published in the moderation charter, and the dedicated procedure for reporting illegal content on the report content page, in accordance with Article 16 of Regulation (EU) 2022/2065 (DSA).
ProMastro does not claim to verify each review individually (see Art. VI.45/1 of the Belgian Code of Economic Law): the appropriate wording is “reviews posted by registered users — some may be supported by a documented relationship or service”. Breaches (fake reviews, paid reviews, self-reviews) are penalised in accordance with the moderation charter.
8. Suspension and termination
ProMastro may suspend or terminate an account in the event of a serious breach of these ToU, without notice if the security of the Site or of other users is compromised.
The user may close their account at any time from their dashboard or via the account deletion procedure.
9. Intellectual property
The Site, its brand (“ProMastro”) and its source code are the exclusive property of their publisher. Any unauthorised reproduction is prohibited.
Content published by users remains their property; the user grants ProMastro a non-exclusive, royalty-free licence to use, display and index such content as part of the service.
10. Personal data
The processing of personal data is governed by the privacy policy, which complies with the GDPR (Regulation EU 2016/679).
11. Role as an intermediary — what ProMastro is NOT
This article describes, in accordance with the duty of fair information and the principle of transparency (Art. VI.45/1 of the Belgian Code of Economic Law), the exact role played by ProMastro and the limits of its liability.
11.1 ProMastro is a directory connecting parties
ProMastro is an online directory service whose sole function is to connect private individuals (Visitors) with Belgian businesses or self-employed persons (Pros). As such:
- ProMastro is not a party to the service contract concluded between the Visitor and the Pro;
- ProMastro does not negotiate, does not conclude and does not invoice the services provided between Visitor and Pro;
- ProMastro collects no payment in respect of the services; no financial flow relating to a job passes through ProMastro;
- ProMastro charges no commission on the services; the only financial flow received by ProMastro is the subscription paid by the Pro for the publication of their listing.
11.2 ProMastro is not the agent of the Pros or of the Visitors
No relationship of mandate, representation, commercial agency, business introduction or employment exists between ProMastro and the listed Pros. Pros are independent entrepreneurs, solely responsible for their activity, their services, and their tax and social security declarations.
11.3 Limits of the checks carried out by ProMastro
The checks carried out by ProMastro are strictly administrative and in no way prejudge the quality, reliability, technical competence, solvency or honesty of the Pros. These checks cover only:
- The existence and validity of the VAT number via the European Commission’s official VIES service;
- The existence of the company number with the Belgian CBE (Crossroads Bank for Enterprises);
- Where applicable and at the Pro’s request, a documentary identity check (KYC) — which relates solely to civil identity, with no verification of professional qualifications.
ProMastro does not verify and cannot guarantee:
- The Pro’s actual technical skills;
- The existence or validity of their insurance policies (professional liability insurance, ten-year liability insurance);
- The compliance of their services with any declared approval or certification;
- The factual accuracy of the descriptions, photos, projects or rates published by the Pro on their listing;
- The absolute authenticity of each published review (see moderation charter).
11.4 Choice of Pro — Visitor’s responsibility
The choice of a Pro and the conclusion of a service contract are the sole and entire responsibility of the Visitor. Before any work begins, the Visitor is expressly invited to:
- Request a written, dated and signed quote;
- Check the Pro’s compulsory insurance (professional liability insurance; ten-year liability insurance for construction work since the Peeters-Borsus Act of 31 May 2017);
- Ask for references and read several reviews;
- Where possible, obtain several quotes for comparison;
- Make sure the Pro is compliant with their tax and social security obligations (active CBE registration, active VAT).
11.5 Exclusion of liability for the Pros’ services
Subject to mandatory legal provisions, ProMastro cannot be held liable for:
- The quality, outcome, completion time or price of the services provided by the Pros;
- Defective workmanship, delays, abandoned jobs, or material or bodily damage caused by a Pro during the performance of a service;
- Disputes between Visitors and Pros, in particular regarding warranties, quotes, invoicing, employment law, insurance, VAT or consumer law;
- Inaccurate, exaggerated or misleading statements that a Pro may publish on their listing, provided that ProMastro had no prior knowledge of them;
- The conduct of a Pro outside the Site (contractual relationship, communication, performance);
- Fraud or a criminal offence committed by a Pro in connection with a service.
For any dispute relating to a service, the Visitor must take action directly against the Pro concerned; the Pro’s details (company name, CBE, VAT) are available on their listing and enable any appropriate proceedings to be initiated.
11.6 Limitation of residual liability
In the event that, notwithstanding the foregoing, ProMastro’s liability is nonetheless engaged in respect of the directory service itself (for example: technical failure of the Site, loss of data, breach of the privacy policy), such liability shall, to the extent permitted by law, be:
- Limited to direct, certain, foreseeable and personal damage, to the exclusion of any indirect damage (loss of business, loss of opportunity, loss of turnover, damage to image, loss of profit);
- Capped at the total amount actually paid by the user concerned to ProMastro during the twelve (12) months preceding the event giving rise to liability — or, for free Visitors, at a flat amount of 100 €.
The above limitations do not apply in cases where they would be legally void, in particular:
- Wilful misconduct or gross negligence attributable to ProMastro;
- Harm to life or physical integrity;
- Mandatory consumer rights (Art. VI.83.30 of the Belgian Code of Economic Law);
- Any other public policy provision.
11.7 Hosting provider status (DSA / e-commerce law)
With regard to content posted online by users (Pro listings, descriptions, photos, projects, reviews, messages, reports), ProMastro acts as a hosting provider within the meaning of:
- Article 6 of Regulation (EU) 2022/2065 of 19 October 2022 on digital services (the “DSA”);
- Article XII.19 § 1 of the Belgian Code of Economic Law;
- Article 14 of Directive 2000/31/EC on electronic commerce.
As such:
- ProMastro has no general obligation to actively monitor content published by users (Art. 8 DSA);
- ProMastro incurs liability only from the moment it has actual knowledge of the illegal nature of a piece of content and has not promptly removed it or made it inaccessible (Art. 6 DSA);
- Any manifestly illegal content may be reported via the “Report” button available on each listing and each review, or by email to contact@promastro.be;
- The moderation arrangements are detailed in the moderation charter.
Automated moderation by artificial intelligence (see Art. 7) does not cause ProMastro to lose the benefit of the hosting regime: it constitutes a proactive prevention measure, in accordance with Art. 7 of the DSA.
11.8 Suspension of accounts in the event of a substantiated complaint
In the event of repeated and substantiated complaints against a Pro (serious breaches, fraud, systematic defective workmanship, lack of insurance), ProMastro reserves the right, pursuant to Article 8 of these ToU, to suspend or terminate the Pro’s account in order to preserve the quality of the directory. Such a decision does not constitute a position taken by ProMastro on the private dispute between the Pro and the Visitor; it relates solely to the management of access to the service.
11.9 Indemnification by the Pro
The Pro shall indemnify ProMastro against any action, claim, complaint or proceedings (judicial, administrative or amicable) brought by a Visitor, a third party or a public authority as a direct or indirect result of the Pro’s service (quality, price, performance, defective workmanship, lack of insurance, criminal offence, tax or social security breach, infringement, etc.). The Pro undertakes to bear all costs, expenses, lawyers’ fees and any financial awards incurred by ProMastro in this context.
11.10 Force majeure
ProMastro cannot be held liable for any failure or delay in the performance of its obligations attributable to an event of force majeure within the meaning of Belgian case law (in particular: major network outage, proven cyberattack despite security measures, failure of an essential subcontractor, decision of a public authority, natural disaster, armed conflict).
12. Amendment of the ToU
ProMastro may amend these ToU at any time. Users are informed of substantial changes by email or by notification on the Site. Continued use after an amendment constitutes acceptance.
13. Governing law and jurisdiction
These ToU are governed by Belgian law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the district of the publisher’s registered office, unless otherwise required by a mandatory legal provision.
